In procurements exceeding the EU thresholds, the contracting entity may define a variety of requirements related to exclusion and suitability, to which the tenderer is required to answer using the structured ESPD form. Exclusion and suitability (ESPD) is only one, albeit very significant, part of the tender. A sufficient amount of time should be reserved for preparing the tender, keeping in mind that also subcontractors (those whose capacity is relied upon and those who capacity is not) and any group members are, for their part, required to answer to the ESPD questions generated.


A precondition for submitting the tender is that all ESPD questions have been duly answered.



An ESPD profile, where the tenderer may save answers that will be populated to a new tender by default, can also be used when responding to the ESPD questions.



‘Exclusion and suitability (ESPD)’ tab



1. Log in to the Tarjouspalvelu.fi supplier portal from the top-right corner of a desired contracting entity.



2. Scroll to the desired call for tenders on the ‘Calls for tenders’ tab and click ‘Open’.



3. Go to the ‘Exclusion and suitability (ESPD)’ tab.


•    Enter the tender validity period using the calendar tool or type the date directly into the field in DD.MM.YYYY format. The tender validity period may not expire earlier than the date set as the minimum by the contracting entity (this is displayed in brackets next to the field).






Filling out the information on a structured ESPD form



A structured ESPD form is divided into sections that are displayed as separate tabs in the Supplier Portal. Some of the response fields may have an associated minimum or maximum requirement that is shown below the field concerned.


•    Text field type of questions are to be answered by writing the answer in text format.

•    Questions concerning quantity are to be answered by giving a numerical value.

•    Yes/No type of questions are to be answered by selecting ‘Yes’ or ‘No’.



When ESPD information is entered, it is possible to check at any time if any field in the form has been left unfilled.


•    Click the ‘Highlight missing required fields’ button.

•    A red rectangle will be shown around sections where an answer is missing.

•    The service is able to indicate the tabs and individual sections in the form where information is missing.





You may navigate between the different sections of a structured ESPD form using the tabs named according to the sections or the ‘Previous’ and ‘Next’ buttons shown at the bottom of the form. The information entered on the form will be automatically saved when you proceed to another section.




In some sections, you have the option of adding a new answer row by clicking the ‘Add row’ button.


•    To expand the answer field, click the button with a black arrow symbol.

•    To delete an answer row, click the button with a red cross.

Part II: Information concerning the economic operator


The questions in the ‘Information concerning the economic operator’ section are populated as mandatory information on those calls for tenders for which the contracting entity has decided to use a structured ESPD. Some of the questions in this section also have related sub-questions that are displayed in response to the answers given by the tenderer.


The ‘Information concerning the economic operator’ section contains the following subsections:


•    A: Information about the economic operator

•    If the economic operator participates in the procurement together with others (as a group), the information under section A pertaining to the group must be filled out.

•    Is the economic operator participating in the procurement procedure together with others? (Only the group leader should answer to the question ‘Yes’)

•    a) Role of the economic operator in the group

•    b) Other economic operators participating in the procurement procedure (define the names of the economic operators)

•    c) Where applicable, the name of the participating group


Note! Invitations to fill out the qualification report are sent to group members from the ‘Submission of tender’ tab. The tender cannot be submitted until qualification reports of all members of the group have been duly filled out and accepted.






•    B: Information about representatives of the economic operator

•    C: Information about reliance on the capacities of other entities


•    Here, the tenderer declares whether or not it uses subcontractors on whose capacities it relies in order to meet the criteria set out by the contracting entity. For example, the actual tenderer company itself meets the requirements pertaining to financial standing and the abilities of the personnel, but relies upon other companies to meet the requirements pertaining to experience or technical capacity. In this case, the tenderer relies on the capacities of another company.


•    The names of the subcontractors to be used must be stated.


NOTE! Subcontractors are invited to respond to the qualification report on the ‘Submission of tender’ tab. The tender cannot be submitted until the subcontractors have duly filled out their qualification report.





•    D: Information concerning subcontractors on whose capacity the economic operator does not rely


•    This section must be filled out if the tenderer itself meets all the requirements, but nevertheless uses subcontractors.

•    The names of the subcontractors to be used must be stated.


NOTE! Subcontractors are invited to respond to the qualification report on the ‘Submission of tender’ tab. The tender cannot be submitted until the subcontractors have duly filled out their qualification report.






Part III: Exclusion grounds


The questions in the ‘Exclusion grounds’ section are of the ‘Yes/No’ type, most of them displaying sub-questions in response to the answers given by the tenderers. The questions included in this section may vary according to the call for tenders concerned, depending on which questions the contracting entity deemed necessary in connection with each respective call for tenders when using structured ESPD. An answer is required for all questions defined by the contracting entity.


Some of the questions included in this section make reference to the directive or other source of law on which the question is based.


The ‘Exclusion grounds’ section contains the following subsections:


•    A: Grounds relating to criminal convictions

•    B: Grounds relating to the payment of taxes or social security contributions

•    C: Grounds relating to insolvency, conflicts of interests or professional misconduct

•    D: Other exclusion grounds that may be foreseen in the national legislation of the contracting authority's or contracting entity's Member State.



Part IV: Selection criteria


The questions included in the ‘Selection criteria’ section may vary according to the call for tenders concerned, depending on which questions the contracting entity deemed necessary in connection with the call for tenders when using structured ESPD. An answer is required for all questions defined by the contracting entity.  


Some of the questions included in this section make reference to the directive or other source of law on which the question is based.


The ‘Selection criteria’ section contains the following subsections:


•    A: Suitability

•    B: Economic and financial standing

•    C: Technical and professional ability



Part V: Reduction of the number of qualified candidates


Note! Part V will only have to be filled out if a two-step procedure is used.


The questions in the ‘Reduction of the number of qualified candidates’ section are of the text or ‘Yes/No’ type, displaying sub-questions in response to the answers given by the tenderers.

Part VI: Concluding statements


The questions in the ‘Concluding statements’ section are populated as mandatory information on all calls for tenders for which the contracting entity has decided to use a structured ESPD.


In the ‘Concluding statements’ section, the following information must be filled out:


•    Date

•    Place

•    Signature(s)



Other terms of tender agreement



The other terms of tender agreement must be completed if the procuring entity has defined them in addition to the ESPD requirements. These criteria can be compulsory or voluntary.




Submitting a request to fill out a subcontractor qualification report


If the tenderer has declared in the ‘Information concerning the economic operator’ section of a structured ESPD form that it relies on the capacity of other entities, such subcontractor is required to file its own qualification report before the actual tenderer will be able to submit its tender. If there are several subcontractors, each subcontractor must fill out its own qualification report.


The subcontractors declared by the tenderer in its tender are shown on the ‘Submission of tender’ tab under ‘Subcontractor qualification reports’.


•    Enter the subcontractor’s e-mail address in the ‘E-mail address’ field.

•    Click ‘Send a request for information’ to send the request to fill out the qualification report.

•    The subcontractor will receive an e-mail that contains a link through which the subcontractor may fill out the qualification report (see also Filling out a subcontrator or group qualification report)



When the request to fill out the subcontractor qualification report has been sent, the colour of the circle before the subcontractor’s name changes from red to yellow.  


•    If the subcontractor has not filled out the qualification report, you may re-send the request by clicking ‘Send a request for information again’.



When the subcontractor has filled out the qualification report, an exclamation mark appears next to the circle in front of the subcontractor’s name.


•    The tenderer may view the answers given by the subcontractors by clicking the pfd file icon to the left of the ‘Accept answers’ button.

•    The tenderer may choose to accept or reject the answers given by the subcontractor by clicking ‘Accept answers’ or ‘Reject answers’, respectively



When the tenderer has accepted the answers to the qualification report given by the subcontractor, the colour of the circle next to the subcontractor’s name changes to green


•    Where necessary, the acceptance can still be cancelled at this point by clicking ‘Cancel approval of the answer’



When all subcontractor names have a green circle next to them and all of the required information has been entered in the tender, the ‘Submit tender’ button activates






Submitting a request to fill out a qualification report for group members



If the tenderer has declared in the ‘Information concerning the economic operator’ section of a structured ESPD form that the tender is submitted together with others (as a group), a member of such group is required to file its own qualification report before the actual tenderer will be able to submit its tender. Each member of the group must file its own qualification report.


The group members declared by the tenderer in its tender are shown on the ‘Submission of tender’ tab under ‘Group member qualification reports’.


•    Enter the group member’s e-mail address in the ‘E-mail address’ field.

•    Click ‘Send a request for information’ to send the request to fill out the qualification report.

•    The group member will receive an e-mail that contains a link through which the group member may fill out the qualification report (see also Filling out a subcontrator or group qualification report)



When the request to fill out the group member qualification report has been sent, the colour of the circle before the group member’s name changes from red to yellow.  


•    If the group member has not filled out the qualification report, you may re-send the request by clicking ‘Send a request for information again’.



When the group member has filled out the qualification report, an exclamation mark appears next to the circle in front of the group member’s name.


•    The tenderer may view the answers given by clicking the pfd file icon to the left of the ‘Accept answers’ button.

•    The tenderer may choose to accept or reject the answers given by the group member by clicking ‘Accept answers’ or ‘Reject answers’, respectively
